Terms of Service

1. Acceptance of Terms

Westlorn is a service operated by Product Command Center Inc ("we," "us," "our"). By accessing or using Westlorn, including the Westlorn app for Shopify (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Service.

2. Service Description

Westlorn provides AI-powered advertising and e-commerce tools. Using product information from a connected Shopify store or a public product page you provide, the Service generates advertising plans that suggest how to allocate ad spend across platforms you select, generates ad copy and creative files, deploys campaigns to connected advertising platforms at your direction, and suggests product pricing. The Service integrates with third-party platforms including Shopify, Google Ads, Microsoft Advertising, Pinterest, and Snapchat.

3. Account Registration

You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account.

4. Third-Party Integrations

Our Service connects to third-party advertising and e-commerce platforms. By connecting your accounts, you authorize us to access and manage data on your behalf. You must comply with each platform's terms of service. We are not responsible for actions taken by third-party platforms. We do not share your OAuth credentials or campaign data across platforms without your explicit authorization.

Current and planned integrations are subject to the following platform policies: Google Ads Terms of Service, Meta Advertising Policies, TikTok for Business Terms, Microsoft Advertising Agreement, Pinterest Advertising Terms, Snapchat Advertising Policies, Reddit Advertising Terms, X (Twitter) Ads Terms, and LinkedIn Marketing Solutions Agreement. 5. AI-Generated Content & Financial Disclaimer

Our Service uses AI models (including Google Gemini, OpenAI GPT, and Anthropic Claude) to generate recommendations, analyses, and content. AI-generated content is provided as suggestions only. You are responsible for reviewing and approving all AI-generated content, including ad copy, creatives, budgets, and campaigns, before use or deployment. We do not guarantee the accuracy or suitability of AI outputs.

Advertising plans, budget allocations, pricing recommendations, bid analysis, and ad strategy suggestions are AI-generated and do NOT constitute financial advice, investment advice, or performance guarantees. All pricing, bidding, advertising spend, and strategic decisions are solely your responsibility. Past AI recommendations do not guarantee future results. We strongly recommend verifying all recommendations with independent professional advice before acting on them.

AI models may produce inaccurate, outdated, or biased results. We do not guarantee the completeness, reliability, or timeliness of any AI-generated output. You assume all risk associated with reliance on AI-generated recommendations.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Reverse engineer or decompile any part of the Service
• Use automated tools to scrape or collect data from the Service
• Exceed your license tier's usage limits
• Share your account credentials with others

7. Non-Compete & Competing Products

You acknowledge that the Service contains proprietary AI models, analytics methodologies, market data, and trade secrets. You agree not to:

• Use the Service, its outputs, AI-generated analyses, advertising plans, pricing recommendations, market data, or any proprietary information to develop, improve, train, or operate any product or service that competes with Westlorn or Product Command Center Inc
• Benchmark the Service against competing products and publish, disclose, or distribute the results without our prior written consent
• Create derivative products, tools, or services based on the Service's AI recommendations, algorithms, analytics frameworks, or methodologies
• Systematically collect, aggregate, or export Service outputs to feed into, train, or enhance any competing platform or AI model
• Use knowledge gained from the Service's features, architecture, or user experience to replicate or substitute any part of the Service

These restrictions survive termination or expiration of your account and remain in effect for 24 months following your last use of the Service. Violation of this section may result in immediate termination and pursuit of all available legal remedies, including injunctive relief and damages.

8. Payment, Billing & Refunds

Paid plans are billed monthly or annually as selected. If you use Westlorn through the Shopify App Store, charges are billed through your Shopify account. We may change pricing with 30 days' notice. Free accounts have access to limited features and credits as described on the pricing page.

Refund Policy: For paid subscriptions, you may request a full refund within 7 days of your initial purchase or renewal if you have not used more than 10 credits during that billing period. Refund requests must be submitted to info@westlorn.com. Refunds for service outages or technical failures may be issued at our discretion on a pro-rata basis. Refunds are processed by our payment provider (Stripe, or Shopify for App Store subscriptions); please allow 5–10 business days for the refund to appear on your statement.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

10. Termination

We may terminate or suspend your account for violation of these Terms. You may cancel your account at any time. Upon termination, your data will be retained for 30 days before permanent deletion.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.
